Professionals are raising awareness among public authorities about the draft law regulating the activity.
Real estate agents are back on the charge regarding the regulation of their profession. This issue is more relevant than ever, given the prospects for recovery that are emerging for the real estate market. At the time of going to press, these ambitions were formulated during a meeting organized in Casablanca under the initiative of the Regional Union of Real Estate Agencies of Casa-Settat (URAI). The opportunity was to discuss the real estate situation and present the broad outlines of the bill on the regulation of the real estate agent profession. A text that has been slow to see the light of day for years. "Our meeting is a decisive point in raising awareness among public authorities about the bill.
It is time for this regulatory framework to take shape, especially since it is one of the key elements of the revival of the real estate sector," Mohammed Lahlou, president of the Regional Union of Real Estate Agencies, told ALM. He added that "we intend to send our proposal to the head of government to activate the adoption of this project submitted to the General Secretariat of the Government since 2017." Speaking about the current situation, Mr. Lahlou indicated that the market is currently showing relatively timid signs of recovery. "We also hope that interest rates do not increase after raising the key rate to 2%. Similarly, in the absence of reform of the sector, we risk stagnation."
According to professionals in the sector, the recovery of the sector requires the upgrading of all its components. Real estate intermediation is also concerned because it is increasingly exposed to anarchy and the proliferation of "Semsars". The proposed regulatory framework aims to regulate this activity and give it more credibility and transparency. The idea is to have structured agencies and regulated interlocutors on the market. In this context of recovery, the institutionalization of the status of intermediaries would help to restore trust between all players in the real estate transaction both during the sale and the rental. It will thus consolidate the role of the real estate agent in strengthening the guarantees of contractual security.
Overall, this bill regulating the profession of real estate agents is structured around thirty articles. It sets out the provisions relating to the organization of the profession of real estate agent as a liberal profession governed by law. The text requires individuals wishing to practice this profession to be of Moroccan nationality, not having been the subject of a final judicial conviction for acts undermining honor, trust and integrity. The agent must hold a Bac+2 or equivalent or provide proof of five consecutive years of experience in this field.
